What Happens If a Website Is Tracking You Illegally
Under the California Invasion of Privacy Act (Cal. Penal Code sections 630–638.55), certain forms of website tracking may constitute illegal wiretapping, eavesdropping, or use of pen register devices. If a website tracked you without proper consent, you may be entitled to $2,500 to $5,000 per violation in statutory damages.
The Federal Wiretap Act (18 U.S.C. section 2511) provides similar protections nationwide, with a minimum of $10,000 per violation. You don't have to be in California to have a claim.
